Disposal of OxyELITE Pro Delayed

The disposal of OxyELITE Pro products in Hawaiʻi has been put on hold in response to a request from a local attorney who wants the products secured for potential use as evidence in future litigation, health officials announced.

Retailers holding embargoed shipments of OxyELITE Pro products voluntarily surrendered their supplies to health department inspectors on Monday.

The state Department of Health issued an alert last month requesting the voluntary removal of the diet supplement from local store shelves as officials investigated multiple cases of acute hepatitis and liver failure that occurred in Hawaiʻi between May and October.

Health officials at the time said OxyELITE Pro was only substance found in common among the patients, which numbered 29 in October, with one death under investigation.

The state Department of Health announced its intent to seize and destroy the embargoed product, but was notified of a written request to the state Attorney General’s office to hold off on the disposal.

The Department of the Attorney General has since taken temporary possession of the products while it evaluates the request, DOH officials said.
