By Sonia Isotov
Retired judge Joel August will be among three speakers to address the Condominium Council of Maui as they gather for their Legal Seminar and Annual Meeting.
The meeting will take place at The King Kamehameha Golf Club in Waikapu on March 28.
Condominium owners and property managers will gather to hear special guest speaker, retired judge Joel August as he presents “How Judges Think.”
Presenting on other legal issues that are common challenges for property owners and managers will be attorneys Ray Wimberley and Peter Horovitz. Attorney Shannon Imlay will moderate the seminar.
Ret. Judge Joel August, formerly a judge with the Second Circuit of the State of Hawaii, will discuss “How Judges Think: Resolving Disputes Effectively.”
His presentation will focus on alternative dispute resolution for owners and his view on views on mediation versus arbitration. Before serving on the bench, August had a general law practice doing some criminal defense and civil litigation work. He shared a practice with Shackley Raffetto (now also a Second Circuit judge) and later with Phil Lowenthal.
Ray Wimberley, Esq. of McKeon Imlay Mehling will present “Are Your Neighbors A Nuisance?” In Ray’s 25 years of litigation experience and work for associations, he recognizes that one person’s nuisance is another person’s lifestyle. Nuisance matters become personal, and Ray will present methods to resolve common nuisance issues such as noise complaints, barking dogs, and overgrown yards.
Peter Horovitz, Esq. of Merchant Horovitz will present “Dos and Don’ts of Collecting from Bankrupt Owners.” He will discuss the types of debt which an association can look to recover, how a bank foreclosure’s action is affected, what constitutes a violation of the bankruptcy stay, and other important bankruptcy questions. Peter is a partner of his Maui firm who represents numerous homeowner associations with regards to bankruptcy.
Registration for the event begins at 8:30 a.m., and the seminar runs from 9 a.m. to 12 p.m. Fee for members is $50 and non-members is $60. A breakfast buffet is included.
