Capobianco was not charged with the terroristic threatening offense, which remains under investigation, but he was charged on the deadly weapons offense and was also charged with violating terms of his release on bail.

The charges stem from a an incident reported at 3 a.m. on Sunday, June 15, 2014, in which police say Capobianco sent a “snap chat” message to several recipients, including a 16-year-old female, which contained an image and a statement that was taken as a threat.

Police say the image and message were captured and forwarded to Maui police for documentation and investigation.

Later that morning, at around 6:30 a.m., police made contact with Capobianco via telephone, and police say he agreed to meet with officers in Lahaina.

Capobianco was later re-contacted, at which time he related he wasn’t going to meet with the police, according to a department report.

Checks in the Lahaina Town area for Capobianco were unsuccessful and an All-Points Bulletin was issued for his arrest.

Members of the Maui Police Department’s Special Response Team and Crime Reduction Unit located and arrested Capobianco in the Wailuku area at around 10:30 a.m. on Monday, June 16, 2014, and transported him to the Wailuku Police Station, according to department reports.

During the custodial search portion of the prisoner intake process, police say a 4 to 6-inch dual-edged knife, disguised as a belt buckle and sheathed within a belt was located on Capobianco.

Police say the incident is not related to the Charli Scott homicide investigation, for which Capobianco has been named a person of interest, or any other on-going investigation.

Capobianco was also arrested on unrelated felony theft and burglary charges in May for an alleged home break-in reported at a home on Eono Place last September.
