Hawaii Marijuana Bill Seeks Legalization

A bill relating to marijuana that would establish a legal market for business to cultivate and sell the substance to individuals 21 and older in the state, is pending introduction.

The Marijuana Policy Project and the American Civil Liberties Union of Hawaii issued a press release this afternoon saying HB 150 will be introduced by House Speaker Joseph Souki (D-8) of Maui.

The bill, as written, seeks to remove penalties for private adult marijuana possession, and establish a system in which the cultivation and sale of marijuana would be regulated and taxed in a manner similar to alcohol.

“Regulating and taxing marijuana similarly to alcohol takes marijuana sales out of the hands of criminals and puts them behind the counter in legitimate businesses that will generate significant new revenue for Hawaii,” said Mason Tvert, director of communications at the Marijuana Policy Project. “Law enforcement resources should be focused on preventing and responding to serious crimes rather than enforcing antiquated marijuana prohibition laws,” said Tvert.

Under HB 150, also known as the Personal Use of Marijuana Act, adults 21 years of age and older would be allowed to privately possess up to one ounce of marijuana and to cultivate a limited number of marijuana plants in a secure and locked location.

The bill also seeks to give the state authorization to license marijuana retail stores, cultivation facilities, product manufacturing facilities, and testing facilities.

Public marijuana use, driving under the influence of marijuana, and use by individuals under the age of 21 would remain illegal, under the proposed bill.

A Q Mark Research poll released earlier this month found 57% of Hawaii voters believe marijuana should be regulated, taxed, and legal for adults. According to an economic analysis performed by University of Hawaii economist David Nixon, the state would generate $20 million per year in new tax revenue and criminal justice savings.

“In Hawaii, as across the nation, arrests for marijuana possession are one of the most common ways that individuals get caught up in the criminal justice system, at great social and economic cost,” said ACLU of Hawaii executive director Vanessa Chong in a release announcing the poll and economic analysis.

Ballot initiatives for the legalization of marijuana were approved in both Colorado and Washington in November 2012.  Supporters of the legislation say similar proposals are expected to be introduced this year by lawmakers in Maine, Massachusetts, New Hampshire, Rhode Island, and Vermont.

The Maui Police Department made a vocal effort during the last legislative session to educate the public about marijuana legislation.  At the time, the department voiced opposition to bills that would have lessened reporting requirements and possession penalties.

    It seems that the police will object to this no matter what, I think part of the reason is the confiscated property and revenue and also they do not want to allow the delegitimization of their failed policy against pot, I hope this bill passes and the rest of the country soon follows.

Trust me even more the police will work even harder with disorderly conduct and way more abuse and more that you’ll come to find out later just hope there will be enough police to get to your own aid and problems that you or your love ones experience……. If you or anyone else think by legalizing marijuana will solve the problem on illegal import and will be better off legalizing marijuana you’re fooling yourselves.. regulated marijuana is what it is” REGULATED “. It will probably cost more then getting it from the illegal black market. Hey if I could get my brand cigarettes cheaper at a illegal black market i’d do it too. So guest what? There goes your so call tax help all up in smoke. By legalizing marijuana, you’d be creating much harm to our local society and communitys. That’s about subject.

            The problem you describe has not materialized anywhere else where it is legal, in fact the opposite is true, ask yourself this, how often do you hear of bootleg cigarettes or beer or anything else, almost never, if legal the criminal element will almost certainly disappear, not to mention the fact that it would be ok to grow it. You are mistaken in your thinking.

            Sorry but you’re wrong. Beer hardly but cigarettes yes. I did in the past have corrections to cheaper and tax free cigarettes but not any more. The guy moved. But I know there’s others out there not to long ago I had a guy buy me a carton and cost me $23.00 . And your assumptions of criminal elements will disappear. You’re wrong in your thoughts. It’ll actually create more problems then good. What you’re not seeing is the whole picture. It’s like you have a tunnel vision of solving one problem but creating ten more. Have you ever compared the positives and negatives in having marijuana legal? You’ll be astound of how much more negative you’ll find over positive. And ask yourself what problems that is the facts that is known that marijuana creates like problems within family’s and friends. And makes you feel like you’re not loved or maybe it makes you feel depressed because you feel like no one cares and don’t understand the way you feel. Well, marijuana affects everyone differently. But, it still affects the same thing the brain’s. I have alot more to say but you should open your eyes wide and see the whole picture. I’ll share more with you later if you need it.             We will have to agree to disagree, you miss my point as well, there are always going to be black market goods of every variety, but when pot becomes legal (and it will) there will be much less need for anyone to smuggle it, people in California proved that, when you can go to a store and pick out some choice buds of endless variety you take that option instead. And your analysis of the effects of marijuana are way overblown, I have no shame in telling you I have smoked plenty over more than three decades and so has more than half of everyone I know my own age, you are undoubtably surrounded by people who smoke but just don’t know it, I have known college professors and even cops and every kind if professional you can imagine who smoke,your analogies regarding it are mostly myth and perception perpetuated by law enforcement.

For example, a study among postal workers found that employees who tested positive for marijuana on a pre-employment urine drug test had 55 percent more industrial accidents, 85 percent more injuries, and a 75-percent increase in absenteeism compared with those who tested negative for marijuana use.

        I think you would be surprised at how many people in law enforcement advocate legalization, some know a failed policy when they see one, the prohibition only puts the money into the hands of cartels and criminals, and the banning of it has not stopped its use and never will.     I don’t smoke and I’ve seen some friends’ kids smoke away all their motivation. I have many friends that prefer taking a hit to taking a shot of alcohol. Alcohol is perfectly legal for adults and marijuana should be too.

    All this going back and forth is so, so amusing that I just laugh. Where is the notion coming from that if pot is legalized and regulated, this will generate significant new revenue for the State? Rather, it makes sense that the opposite would happen. Costs for regulation and enforcement would tip the scale into the red. All the illegal growing and selling surely will not stop, which would stifle any “significant new revenue”. The only ones who would see their revenue increase will be food establishments as there will be countless pothead zombies with the “munchies” all over the place. Hawaii is already being recognized for some other legalized issues (this one will open a can of worms, I know), and now this? C’mon, Mr H.S., what are you thinking? Silly, silly man.

      Your characterization that pot puts the user into a zombie like state and makes you need some snacks is evidence that you do not have a clue about the subject. And if people are licensed to sell (just like a liquor license) there will be a fee, and people would rather go buy top shelf buds at the store, same with growing it, some people will, most won’t though, just like they could make their own alcohol but mostly do not.           I don’t at all doubt that you actually read these things, I dispute it’s credibility, as with all studies their findings can be slanted depending on where the funding is coming from, we could go back and forth endlessly, and I could waste my time pasteing opposite findings, but to what end? I have no stake in this, you are free to believe what you choose to, I do not presume to change your mind, all I know is it will become legal in the near future and the socioeconomic effects will be positive for the most part, that has already come to fruition

          Your opinion is completely borrowed from someone else’s thoughts on the Internet, so to call them your own is really not accurate, my analysis is based upon truth and hard evidence, not bunk studies funded by legalization opposition, I would like to see the cartels and underbelly of society deprived of that money by making it a legitimate business, might as well because its not going away legal or not.
