Hearing for Sand Mining Lawsuit Continues in Environmental Court
An evidentiary hearing continued with additional testimony on Wednesday in Maui’s Environmental Court over sand mining activities at the Maui Lani development.
The lawsuit was filed by the group Malama Kakanilua, seeking protection of burials and compliance with archaeological monitoring at the site. Other parties represented in the suit are Maui residents Clare Apana and Kaniloa Kamaunu.
A temporary restraining order blocking grading activities at the location was filed on August 2nd and was in effect for 10 days. According to court documents, attorneys for Maui Lani Partners said that they would notify the court if the state or county were to impose any required activity while the case is under review.
The evidentiary hearing on a motion for a preliminary injunction has been continued to Monday, Aug. 28th at 10 a.m. before Maui Judge Joseph Cardoza.
