Maui police have reclassified a burglary investigation as a second degree murder investigation after the victim died as a result of injuries in the incident, police tell Maui Now.

The case stems from a burglary reported on June 20, 2019 at the Harbor Lights condominium complex, located at 111 Kahului Beach Road.

Police say 90-year-old Jacqueline Oberheim was attacked in her sleep during the incident, and has since died as a result of her injuries.

Grand jury indictments were handed down on June 28 against Lewellyn Foster Jr. and Aaron Wilsey in connection with the burglary of Oberheim’s residence.

  • Lewellyn Foster Jr. was charged with first degree robbery, first degree burglary and first degree assault.  Maui Judge Joseph Cardoza today ordered that Foster be held without bail.
  • Aaron Wilsey was charged with first degree burglary, second degree robbery, second degree theft and first degree unauthorized entry into a motor vehicle. According to court records, a request to continue the matter for one week was granted and a bail hearing was continued to July 16, 2019. Wilsey was being held in lieu of $250,000 bail at last report.
  • A third individual, Chery Moniz was charged with first degree burglary and her bail was maintained today at $50,000.  Her attorney had requested a reduction in bail to $10,000, but the request was denied.

All three had entered not guilty pleas on July 3, 2019.

As of this morning, Maui Police Lt. Gregg Okamoto said the investigation was upgraded to second degree murder, and charges had not been filed to reflect the reclassification of the investigation.  Authorities say the investigation is ongoing and that further details are not available at this time.
