Stop Cane Burning’s lawsuit against the Director of the Department of Health and Alexander & Baldwin, seeking to stop cane burning activities on Maui, has been settled.

A group of protesters held signs outside of the State Building in Wailuku on Friday on the heels of a hearing on Wednesday in which the state was able to postpone a temporary injunction on cane burning.

The Maui Planning Commission today rejected a request for the inclusion of sugar cane smoke as a factor when granting special management area use permits.

The Maui group Stop Cane Burning has filed a new motion in Second Circuit Court seeking injunctive relief to invalidate the 2015 Burn Permit issued to Hawaiian Commercial & Sugar Company and ban parent company A&B from conducting agricultural burning operations on Maui.

The Maui group Stop Cane Burning filed a lawsuit on Wednesday against the state Department of Health, seeking an injunction to immediately stop agricultural burning on Maui and effectively invalidate the burn permit issued to Hawaiian Commercial and Sugar Company. The lawsuit is the first to be filed on Maui in the new Environmental Court, and alleges that the regulatory system which allows the open air burning is unconstitutional.

A group that seeks to stop cane burning on Maui announced an upcoming forum and meeting scheduled to take place tonight, Thursday, June 25 at 6:30 p.m. at the Kīhei Community Center.
